The company operating the website checkoutera.com engaged in materially false and misleading YouTube advertising in violation of the FTC Act (15 U.S.C. § 45) by misrepresenting the size, functionality, and capabilities of a product marketed as “Wuffy Dog.” The YouTube advertisement depicts a larger-sized robotic puppy that clearly appears to: • Bark realistically • Recognize and respond to voice commands • Sit on command • Wiggle its tail • Follow a person through voice recognition • Walk and run independently • Sit up and beg on command These demonstrations convey the false impression that the product is an advanced, interactive, voice-responsive robotic pet with autonomous movement and behavioral intelligence. The product actually delivered is substantially smaller and does not perform the advertised behaviors. It does not reliably bark, does not recognize or respond to voice commands, does not follow a user, does not walk or run as demonstrated, and lacks the interactivity shown in the advertisement. The discrepancies between the advertised product and the product received are material and would be likely to mislead a reasonable consumer. The advertising relies on staged demonstrations and visual exaggeration to induce purchases. I relied on these false representations when making my purchase. Had the product’s true size and limitations been disclosed, I would not have purchased it. I believe this conduct constitutes deceptive acts or practices, false advertising, and consumer fraud, and I am submitting this report to assist the FTC in identifying a pattern of deceptive commerce.
