California landlord taking deposit for paint Hello, After leaving an apartment where I had been renting for more than three years, the landlord kept the full amount of a wall repainting. The walls had no major damages, just tiny holes due to nails for hanging pictures (I took pictures). Also, the landlord had authorized me (in email), to touch up the walls with the exact same paint. This doesn't seem right to me. Both a Nolo book and the state's website seem to agree: http://www.dca.ca.gov/publications/landlordbook/sec-deposit.shtml I told him that he was incorrect, but he won't budge. I have two questions: 1) Am I right that I should have been refunded the full amount? 2) If so, is the right next step to take him to small claims court? I understand that this is not a lawyer's advice. I am just looking into feedback. Thanks, Tony
