Florida speedy trial questions. I live in Florida and I've been charged with a misdemeanor criminal traffic offense. It has been over 100 days since I was charged. Florida law is 90 days for speedy trial of a misdemeanor. There was an extension of 30 days ordered by the court's own motion that has expired. I have always been available to the court. My trial is set for 40 days from now. I was not arrested. I was issued a citation to appear in court. I did not know for what date until I received a letter from the county clerk. 1. Day 1 of the 90 starts the day after citation was issued, right? 2. Does an extension ordered by the court's own motion add to the 90 days? If so, I assume that the beginning and end date of the extension don't count towards speedy trial time limit. 3. So, am I right in thinking that I can file a motion ~~of discharge~~ on day 91 (taking into note weekends and the day of incident)? ~~4. How do I file for discharge? Write a letter or fill out a form? Give it to the prosecutor? Or wait until my trial date and make a motion?~~ ~~5. Should I make sure that there are no other court ordered extensions before filing?~~ ~~6. Rule 3.191 (p) is confusing me. I don't have to file "Notice of Expiration of Speedy Trial Time," right?
