Per diem travel expenses required by law? My employer normally allows for per diem expense reimbursement for any travel. This is company policy and may even be law? Not sure how it works for private companies. Anyway, for a project that's coming up, we are eligible for prevailing wage. The people in charge of this particular project has told our department that we are not entitled to per diem because of prevailing wage. I have never heard of this. I feel like, because we are traveling, we are entitled to the per diem for meals and hotel expenses. What makes this sound even fishier is they have said they will "allow" us to expense the first night of hotel stay but we are responsible for the rest for a given week. This sounds to me like they are trying to "throw us a bone" to keep us from seeking reimbursements for what we would otherwise be entitled to by law. Any advice on how I can proceed? If my employer is not required by law to reimburse per diem rates, do we have any argument we can take up with the company policy that states we get per diem for any overnight travel 50 mi or more away? Edit: Sorry for not being specific. I am employed in Easton, PA. I will be dispatched across PA along the turnpike. From Pittsburgh to Philly, all across PA.
