Father died due to a recalled medical product. Need advice on best way to proceed My Dad was fitted with a DAVOL INC produced Kugel Patch as part of a hernia operation about 10 years ago in Toronto. On June 26th he died due to complications resulting from this patch. DAVOL’s parent company BARD, discontinued the patch due to a number of problems associated with it: http://www.davol.com/products/soft-tissue-reconstruction/hernia-repair/ventral-hernia-repair/open-repair-options/composix-kugel-patch/ I assume they admit fault as they’ve since put aside $184m to settle the majority of law suits: http://www.newsinferno.com/defective-medical-devices/c-r-bard-agrees-to-settle-most-kugel-mesh-hernia-patch-lawsuits/32032 There is a class action law suit ongoing in Canada: http://classproceedings.ca/ca_categories/hernia/ but as these seem to deal with complications rather than death as a result of the patch, I’m looking for advice on whether I should join the class action or file a separate complaint. And if I should go independently, what is the best course of action to take as I have limited resources to fund this. My Dad moved to the UK in 2006. I also live in the UK.
