Can a motorcycle dealership sell a used motorcycle that cannot pass state inspection? Location: Pennsylvania, USA I am in the process of purchasing my very first motorcycle. The week after I got my permit about a month ago, I went to a dealership to check out several bikes I was interested in. I went to one specific dealership since they offered free delivery of motorcycles to the home of a buyer. Given I live in an area surrounded by interstates, that was a worthwhile perk. I sat on several bikes, and ended up falling in love with one of them. Since I wanted to wait until I passed my MSF course and got my class M stamp before getting insurance, I asked them to hold it for me. They stated that due to the longer duration (1 month, approximately) instead of being refundable, it would be a *non-refundable deposit.* In the intervening weeks I have been working on my MBA classes and getting my MSF (motorcycle safety foundation) classes completed to get my license. Now that I am less than a week from purchasing, I have been doing additional research and found that the price of the bike is significantly higher compared to other dealerships. That alone isn't the issue, if it was I would just eat the loss. Looking at the bike, I noticed that there are several aftermarket modifications which the dealership presented as a value-add. Most importantly, it features something called a "tidy tail" from a company called Maxnus. This is a replacement rear fender sold in Asia. It removes the separated turn signals and rear brake light, and integrates them into a single line of LED lights. My understanding of Pennsylvania motorcycle law is: 1. A replacement fender must be the same size and dimensions of the original fender. This is not. 1. PA considers LED lights to be cosmetic, and not acceptable for use as an indicator light.
