Need advice/assistance with taking landlord to court in NC for failure to refund security deposit. Hi, I moved out of an appartment about 4 months ago and communicated for about a month with my landlord to get my 1250 back for a security deposit. Only my name is on the lease and the deposit check. I was in contact with the landlord for the first month after moving out, he said he sent the refund check but I never received it. After talking to him via telephone and text, he said he would send another. We live in the same county and the mail should only take a couple days to arrive. Anyway, I've called him several times since and he refuses to answer. I've sent a letter via certified mail, but received no response, and I've given him my address 3 or 4 times already. He is simply avoiding paying me my deposit. I also haven't received an accounting as to any damages he might have taken out, which I am under the impression that he is required to do. The amount isn't really worth getting a lawyer and the case seems clearly in my favor. In NC a landlord is required to return the security deposit within 30 days or atleast provide an accounting of any damages. The bum landlord lives in Wake county and the forms I am going to fill out are at http://www.nccourts.org/Forms/Documents/346.pdf and http://www.nccourts.org/Forms/Documents/822.pdf . My questions for reddit are: - Is my case a guaranteed win? I've done everything I can to contact him, sent one certified letter and called at least a dozen times only to never have him return my calls. - On the 346.pdf form, should I check the box "For conversion" or which one? - Is there any applicable interest since it's been 4 months? - What else would you guys recommend I do in order to successfully get my money back in court? I don't want to miss some technical detail and have my case thrown out. - Any other suggestions? Thank you for your help and I'll update you guys if anything else happens.
