Wedding Photographer situation: Would it be reasonable to ask for/ would we be entitled to a partial refund? Location: California We hired a photographer for our wedding last year and the service entailed, per the contract, "1 roll of 35mm film, which includes both development and digital scans. While prints are not included, you’ll have the option to purchase prints from a professional lab using the negatives I provide." This portion of the contract has yet to be fulfilled and they have been trying to give us the run around in different ways for some months now. There are a lot of messages that provide context to this situation but it is extensive. The latest response from them in regard to the films is: "Regarding the film, I sent all rolls to the lab for processing, and unfortunately two of those rolls—including yours—came back completely blank. This is something that can occasionally happen with 35mm film due to factors outside of my control during development. As outlined in Section 9.3 of your contract, I’m not held liable for undeliverable work resulting from lab or technological failures that are beyond my control." The Section 9.3 that they are referring to says this: "9.3 Failure to Deliver . Photographer shall not be held liable for delays in the delivery of such Work Product, or any Work Product undeliverable, due to technological malfunctions, service interruptions that are beyond the control of Photographer (including as a result of delays in receipt of instructions from Client) and for Work Product that fails to meet the specifications set out in Section 1.1 due to the actions of Client or attendees at the event, that are beyond the control of Photographer (e.g., camera flashes)" Here is a link to the full contract for reference : [https://photo-and-film.tiiny.site](https://photo-and-film.tiiny.site) Thanks!
