Legal question about egg donation. I know this is a internet forum and the information given here does not constitute legal advice in any way. No attorney client privileged is formed whatsoever, and all comments here are merely suggestions and ideas to the point. If I am in need of actual legal counsel I should contact a lawyer in my area. On to it then! My husband and I had a lively debate on egg donation last night that stalled at a serious question that we are finding conflicting information on. Let's say that hypothetically a wife who is a legal resident of Arkansas wanted to donate her eggs to a fertility clinic whose intent was to put it in another person and create a baby but her husband was opposed to it. Would she need his permission to donate eggs? Is there a law that would require the husband and wife to legal enter into the egg donation contract together with the clinic? According to this website http://www.surrogacysolutions.net/donors.htm They require the husband to give permission but I was curious whether this was merely "want" on their part as opposed to a state or federal law on the subject. Also, this is merely one clinic of many. The others don't have it listed as a requirement (but they might just not have it posted) Could the husband keep the wife from donating? And if she did could he sue her for damages? And this brings up a larger question of ,if this is possible, whether he would be able to stop her from donating organs or plasma or blood? And could she keep him from donating his sperm? I was unable to find a state law related to this. Has anyone ever encountered this or know anything about this? What crime is being committed? Any help would be greatly appreciated! As an aside, I don't plan on donating without his support, but this question isn't about that.
