Sent my landlord a written notice through certified mail, and conveniently his mail is on hold—help please! Location: Florida According to the FL Bar website, you can send a 7 day notice to your landlord regarding their non compliance/violation of the lease. He is way past 7 days of non compliance (we’re talking an ongoing issue since February) and things are coming to a head with him. He’s broken his own lease and is very objectively in violation of FL Statues. They say that the notice needs to either be hand delivered or sent via certified mail with USPS. Here is the link to the form: https://www-media.floridabar.org/uploads/2018/08/form-3.pdf Now, this guy has a history of being extremely shady and a liar (not to mention being verbally aggressive on the phone). We decided to send the letter via certified mail and got the notice that it wasn’t delivered to his house, but that his mail is on hold so it’s sitting at his local distribution center. Seeing that the letter would’ve arrived today if he hadn’t put his mail on hold, I have the following questions: 1. Would today be the day that starts the 7 day period of his notice despite him not technically receiving it yet? 2. Can he claim that he never knew about the notice since his mail is on hold, giving him leverage over us for not giving proper notice and beholding us to the lease? 3. If we decide to try to hand deliver it to him, can we have someone else do it for us? We fear he wouldn’t answer the door if we came by, but would for someone random. Some more context: We mailed the letter Friday (it’s also physically dated for Friday) and have all the tracking info from USPS. Just want to make sure I fully understand in this case when our 7 days starts and if he actually has a legal loophole to avoiding mail from us.
