Wrongful tow from apartment in Dallas, TX Location: Dallas, TX My car was towed from my apartment complex on the night of June 6, the day I left for vacation. I returned June 12 to find it missing. My vehicle was parked in a residential space, behind the access gate, and didn’t violate any towing condition listed in my lease. The tow company and apartment complex stated my car was towed due to it not being registered in the complex’s parking management system. The issue is that the complex uses two registration systems: a resident portal and a third-party platform called ParkingBadge. My vehicle is registered in the resident portal and I personally notified the leasing office when I got a new car, but was never told to register in ParkingBadge. When I raised the issue with management, they reiterated I had to be registered in ParkingBadge and sent a parking policy document in their response, which explicitly states that ParkingBadge registration via pb-guest.com is required for unpermitted vehicles and guests, not residents. Their own document contradicts their justification for the tow. The policy also requires a visible parking permit on the windshield, but no permit was ever issued to me during my tenancy, and the majority of vehicles in the lot don’t display one and haven’t been towed. Also worth mentioning, I never received a notice prior to the tow, despite that being established practice at this property. My current vehicle sat in the lot for approximately three months without issue before suddenly being towed the day I left for vacation. My questions are: does the parking policy contradiction effectively gut the complex’s defense? Are there Texas-specific statutes I should be aware of? And is it worth pursuing both the complex and towing company as co-defendants in JP court?
